I do not think this would pass constitutional muster .. 1st amendment and 4th amendment in particular .. they would need to a court process before rights can be taken away.

the fatal shot seems to have been deflected into his neck by body armor... Many different variations out there on this basic theory, but this really seems to show the outline of body armor under his shirt.

I thought so too when I first saw that angle, but later many clips and photos show he clearly was not wearing armor.
If he was wearing soft armor it would absorb it and if he was wearing plates the carrier would be obvious as hell and rounds tend to fragment in to bitty pieces.
Also if it had hit the t-shirt, we'd see some hole where it did
The black mark on his upper right chest is a magnetic mic. It attaches to a magnet inside the t-shirt. There's a clip of him actually putting it on that day and also confirmed with nipples showing no soft armor or plate carrier.
I'll agree that guy make a compelling case!

I realized that angle is different than the two I saw.
I've watched it 15-20 times and while I still dont see a plate carrier, I DO see the black smudge on the t-shirt at the neckline on this shot. Could be
