If you plug the device in and it works, stop worrying about it. Next you'll be setting up a laser level to see how off your foundation is (Tip, don't do this!!!)
Its certainly not as good as lower, but its an easy mounting spot that means it won't get wet, and won't need to drill through the brick, and will look better from the outside

SMR is Shingled Magnetic Recording, where the magnetic tracks overlap. It means you can get more data on the disk platter so they are cheaper to produce, however it comes at the cost of performance
Illegal here in the USA. I've personally warrantied at least 10 of them, no problems. Sometimes they question it say say "As a one time exception" they will cover it
