Who do you think is responsible? I called the police shortly after the accident to let them know I had a video of the crash. They called be back the next day and gave a link to upload the video for the accident report. The car took out a section of the fence on the corner property.
I think both drivers were at fault. The truck wasn't that far into the lane and the car didn't do anything to avoid the truck. That's likely how an insurance company would see it. Shared responsibility.
Hmm... oncoming traffic adjacent to the vehicle as it hit the truck that was impeding the right-of-way. Certainly could argue that there was not enough room to avoid the truck based on their split-second judgement.
Is visibility bad on that corner the truck entered from? Pick-ups do sit higher, was he out that far to see to the right?
Double Dumbass clause should be in effect. Inattentive driving on mover....stupid prizes award for pickup....Neither took action to avoid collision......
